b) Each work is handmade. As a result, minor variations in structure, texture and execution may occur due to the nature of the materials used and the handmade technique.

c) Information relating to a specific work, including its title, dimensions, year of creation, materials, framing, availability and price, is provided alongside the work or communicated to the Buyer before the contract is concluded.

d) Unless otherwise stated in the description of a particular work, each composition is a unique, one-of-a-kind piece.

3. Placing and Concluding Orders

a) Orders for completed works and enquiries regarding individual commissions may be submitted by email or via direct messages on Instagram at @linolinepl.

b) Before the contract is concluded, the Buyer receives information concerning the subject of the order, its main characteristics, price, payment method and terms, estimated completion or dispatch date, delivery method, and the applicable rules on withdrawal from the contract and complaints, where relevant.

c) In the case of distance sales, the contract is concluded once the Buyer has accepted the agreed order terms and the Seller has confirmed acceptance of the order for fulfilment.

d) Confirmation of the conclusion of the contract and information concerning the order are provided to the Buyer on a durable medium, in particular by email.

e) For individual commissions, detailed terms of fulfilment may be set out in a separate agreement.

4. Individual Commissions

a) Linoline also undertakes works created in accordance with individual arrangements agreed with the client.

b) Depending on the nature of the commission, the following are agreed in particular: the format and proportions of the work, colour palette, project scope, execution method, framing, completion date and fee.

c) A deposit of 35% of the total order value is required for individual commissions. Information concerning the deposit amount and the deadlines for remaining payments is provided to the Buyer before the contract is concluded.

d) For larger commissions, the terms of cooperation are set out in a separate agreement. The Buyer is provided with a draft agreement for review before entering into it.

e) The completion date is agreed taking into account the scope of the commission and the current work schedule.

f) Once the work is completed, the Buyer may receive photographs of the finished piece to confirm that it corresponds to the previously agreed specifications.

g) The remaining balance for an individually commissioned work is payable before dispatch, after photographs of the completed work have been provided and the Buyer has approved it, within the period specified in the order arrangements or the separate agreement.

5. Prices and Payments

a) Prices are stated in Polish zloty (PLN) and represent the final prices payable. The Seller benefits from VAT exemption in accordance with the applicable regulations.

b) Before the contract is concluded, the Buyer receives information about the total price of the order, any additional costs and the available payment methods. Payment for completed works may be made by bank transfer to the Seller’s bank account or in person upon collection, if this has been agreed in advance. Payments for individual commissions are made in accordance with the arrangements agreed for the particular order or the separate agreement.

c) The Seller issues an invoice or other appropriate sales document in accordance with the applicable regulations.

6. Fulfilment and Collection

a) Completed works are prepared for dispatch once payment has been received.

b) The standard preparation time for a completed work to be dispatched is 1–3 business days, unless a different timeframe is specified for the particular work.

c) For works made to individual commission, the completion timeframe is agreed before work begins. It is usually 30 business days.

d) For individual commissions, completion of the work may be confirmed on the basis of photographs sent to the Buyer.

e) Personal collection is available in Sosnowiec by prior arrangement.

f) In the case of personal collection, the Buyer is required to collect the work at the agreed time or arrange an alternative time with the Seller in advance.

7. Delivery

a) Standard delivery within Poland is included in the price of the work.

b) The Seller presents the Buyer with the available transport options for the particular order. The Buyer may choose the carrier and delivery method from among the options presented.

C) Works exceeding standard parcel dimensions and unsuitable for courier delivery are transported by a selected transport company. In such cases, the Seller presents current offers from different companies, and the Consumer chooses the most suitable option. The costs of non-standard transport are borne by the Consumer.

D) Additional charges may apply if faster transport or a non-standard delivery service is requested. The amount is communicated to the Buyer before dispatch.

E) International shipping is also available. The cost and method of international transport are agreed individually before dispatch.

F) For shipments outside the European Union, any customs duties, import taxes and other charges associated with bringing the goods into the destination country are borne by the recipient, in accordance with the regulations applicable in that country.

G) Works are appropriately protected for transport, taking into account their dimensions, construction and nature.

8. Right of Withdrawal

Completed Works

a) A Consumer who has entered into a distance contract generally has the right to withdraw from it within 14 days without giving a reason.

b) In the case of a contract for the sale of an individual work, the 14-day period begins on the day the Consumer, or a person designated by the Consumer, takes possession of the work.

c) A notice of withdrawal may be submitted electronically, in particular by email.

d) In the event of a valid withdrawal from the contract, the Seller refunds the payments received from the Consumer in accordance with the applicable regulations.

e) The Seller may withhold the refund until the returned work has been received or the Consumer has provided proof of having sent it back, whichever occurs first.

f) If the Consumer chose a delivery method other than the least expensive standard delivery method offered by the Seller, the Seller is not required to reimburse the additional costs resulting from the more expensive delivery option.

g) The direct costs of returning the work following withdrawal from the contract are borne by the Consumer.

Returning a Work

h) If the Consumer withdraws from the contract, the Consumer must return the work in a manner that provides adequate protection against damage during transport.

i) The work should be packed with due care and in a manner appropriate to its dimensions, construction, framing and nature. Where possible, the packaging and protective materials used for the original shipment are recommended.

j) The Consumer is liable for any diminished value of the work resulting from handling beyond what is necessary to establish its nature, characteristics and functioning, including any reduction in value resulting from inadequate protection during return shipping.

k) The Consumer is advised to retain the packaging materials until the withdrawal period has expired so that the work can be properly protected during transport if it is returned.

Works Made to Individual Commission

l) The Consumer does not have the right to withdraw from a distance contract concerning non-prefabricated goods made to the Consumer’s specifications or intended to meet the Consumer’s individual needs, in accordance with Article 38(3) of the Polish Act on Consumer Rights.

m) In the case of individually commissioned works, this exception applies where the particular work has been made according to the Buyer’s individual specifications or to meet the Buyer’s individual needs.

n) Information that the right of withdrawal does not apply in a particular case is provided to the Buyer before the contract is concluded.

9. Complaints and Non-Conformity of Goods

a) The Seller is liable to the Consumer for the conformity of the goods with the contract in accordance with the applicable regulations.

d) Where possible, the complaint should describe the identified non-conformity and indicate the requested resolution. Photographic documentation may be attached to the complaint.

e) In the event of non-conformity of the goods with the contract, the Consumer may exercise the rights provided for by the applicable regulations, including requesting repair or replacement and, in cases specified by law, a price reduction or withdrawal from the contract.

f) Where the nature of the non-conformity justifies repair or replacement, the Seller bears the costs of bringing the goods into conformity with the contract, including transport costs, in accordance with the applicable regulations.

g) The Seller considers complaints within the time limit prescribed by the applicable regulations.

h) Rights arising from non-conformity of the goods with the contract are independent of the right to withdraw from the contract.
